Corporate Disputes

Our disputes team consists of eight lawyers with well over a century of collective legal experience. The team has corporate and commercial streams ensuring expertise in the area which concerns you.

We work with you to obtain the best possible outcome in the shortest possible time. We understand how disruptive litigation is to your key focus, doing business. With that in mind we aim to work with you to understand the dispute and then to make your problem our problem. This leaves you free to concentrate on what you do best, leaving us to do what we do best.

Amongst other things, our team members have:

  • represented the holders of debentures issued by an Adelaide finance company which subsequently went into liquidation. The claims arose from breaches of the Corporations Act in connection with the issue of the debentures and the administration of the debenture deeds. The Supreme Court action ultimately saw debenture holders recover all principal and interest
  • acted for bond holders in complex litigation involving the redemption of a $12 million zero coupon off-shore bond issue.  The matter resolved after a week long mediation
  • represented the RE of a registered managed investment scheme in the private equity industry, in claims of misfeasance and maladministration against the former trustee in connection with transactions valued at more than $10 million
  • defended a financier in, and successfully resolved, a multi-million dollar claim in the Federal Court arising from South Australia's then largest reported corporate fraud
However, in many respects the examples we are most proud of are the ones you would have never heard of. These are disputes which were settled, using our collaborative and pro-active approach, before they got to Court. A recent example of this was our role in acting for a minority shareholder in an oppression claim resulting in a seven figure settlement at mediation, before the issue of proceedings.
